Terms & Conditions ATM Debit Card

I do hereby understand; read and have agreed to the below mentioned terms and conditions for the use of Debit card (the card/ my card) issued by FINCA Microfinance Bank Ltd. (hereinafter "the Bank"), against my Account.

I understand I am the only individual authorized to use this Debit card(referred to as your "card"). Retaining and using the Card, signifies agreement to the following terms and conditions.

I, hereby agree as follows:

1. That these terms and conditions will become effective as soon as the card is issued to me by the Bank.

2. That I will keep the Personal Identification Number (PIN) code confidential and strictly secret.

3. That I will not let any unauthorized person use or have access to the card, the PIN and card details.

4. That I will not store the PIN code in my mobile phone as well as never write them on the Card.

5. That I will regularly change my PIN and avoid using easy-to-guess PINs.

6. That I will not enter my PIN in front of any other person while using my Debit Card at POS terminals.

7. That I will not disclose personal or financial information including my CNIC number, address, mother’s maiden name, telephone number to any person, organization or to little-known or suspicious websites.

8. It will be my sole responsibility to safeguard my card number, expiry date and PIN. If any transaction on theDebit Card comes to my knowledge, which has not been validly authorized by me, or my registered phone/SIM is lost or stolen, I shall immediately notify the Bank about the incident by calling 042-111-111-562 or by way of a written communication at the relevant/nearby branch or any other way of communication that is acceptable to the Bank and get the card blocked.

9. That I will not under any circumstances give any personal information in response to a voice call on my mobile phone that claims to be from the Bank.

10. That I will not under any circumstances enter the PIN code on any website, link received in an SMS or email, or on any other medium which asks for my personal credentials until or unless I myself need to enter these information for bonafide purpose.

11. That on the slightest suspicion or knowledge that my PIN or other details or any part of them, or any personal information referred to herein are known to someone else, I will immediately change the PIN as applicable by notifying the Bank on Call Center No. 042-111-111-562

12. That I will not let other people use my Debit Card. If my Card is lost or stolen, I will immediately report the incident to the Bank by calling the FINCA Call Centre on the number 042-111-111-562 or any other number notified by the Bank in this respect from time to time.

13. That I shall immediately communicate in writing any change in my address to the Bank. No responsibility shall be accepted by the Bank for delay, non-delivery of communications sent by the Bank to the customer on the address provided by the customer.

14. That the Bank may from time to time and at any time in its absolute discretion as and when feasible, unilaterally revise, amend, delete or supplement any of these Terms and Conditions & Pricing of the product, whether in whole or part.

15. That any such change to the Terms and Conditions & Pricing shall be communicated to the customers through either the Bank’s website, e-mail, IVR, voice mail and/or text message to the Customer’s mobile phone. Such amendments/alterations may also be displayed at the Bank's premises from time to time and shall be binding on the Customer.

16. By continuing to use any existing or new services as may be introduced by the Bank, I shall be deemed to have accepted the changed Terms and Conditions.

17. The grant to, and use of, the Debit Card and Services by a Customer is purely personal in nature and is neither assignable nor transferable under any circumstances. If I authorize anybody else to use the Card, despite this prohibition, then I will be exclusively responsible for any and all risks and consequences.

18. FINCABank expressly reserves the right, at any time and without prior notice to the Cardholders, to add to and /or alter, modify, change or vary all or in part, the % discount offers, or withdraw it altogether. Nothing contained in % discount offers shall be construed as a binding obligation upon the Bank or any participating establishment to continue it in the event of the termination or expiry of the validity of discount offers or otherwise.

19. The bank reserve the rights without prior notice at any time or from time to time to reduce or increase total cash allowed to be withdrawn by any Cardholder from the ATM/DEBIT machine during any period. The Bank also reserves the right to change the limits of the Card Transactions carried out through POS Terminals without any prior notice to the Cardholder. Daily Minimum/maximum transaction limits may vary between different ATM/DEBITs belonging to different banks or a linked network. The Bank is not responsible for any loss or inconvenience that the Cardholder may suffer due to lack of uniformity in these limits, from transaction through different ATM/DEBITs or Linked network.

20. The Bank is not liable in any way for the quality, quantity or acceptability of any goods or services purchased by the use of the card by the Cardholder or for any additional amount charged by a merchant service/retail outlet(s), or for any breach of the card holder transaction by a merchant service/retail outlet(s).In any aforementioned event or in the event of dispute between the cardholder and a merchant/service/retail outlet(s) the cardholder is liable to the bank shall in no way be affected, reduced or suspended.

21. That the Bank may publish notices of a general nature, which are applicable to all Customers, through SMS, in newspapers or on its website. Such notices will have the same effect as a notice served individually to each Customer. Moreover, the Bank can send notifications regarding services and general instructions to Customers through any of the above mentioned channels.

22. That the Bank will not be responsible for any loss caused by failure in ATM service for any reason whatsoever including any mechanical fault, communication lines or internet link downtime/failure or power breakdown and blockage of the card due to successive wrong entry of PIN etc.

23. All Transactions conducted with use of the PIN will be customer’s responsibility. I agree that I am allowed to withdraw only a certain amount of cash per transaction per day as determined by the Bank irrespective of the credit balance in my Account(s).

24. That I understand that the use of the card shall at all the times be subject to terms and conditions currently in force for the time being irrespective of my actual receipt of the bank’s notice or knowledge thereof.

25. That I undertake utilize my Debit card on various alternate delivery channels where the FINCA bank has enabled this feature and the bank is authorized to l maintain the record of my Debit card usage for record retention.

26. That I undertake to pay all charges in respect of the card/usage of the card e.g. Card Issuance, Annual/Renewal or any other applicable charges in accordance with the bank’s prevailing Schedule of charges (SOC) which may be changed from time to time at the sole discretion of the bank and on non-recovery of the abovementioned charges, my Debit/ATM card will be temporarily blocked by the bank which may be reactivated on payment of such fee/successful fee charging.In case of non- recovery of pending/applicable charges for my Debit card, the bank is authorized to hold my funds (for applicable charges & govt. levies/FED) in my account and subsequently deduct the charges .

27. I undertake to pay all charges, tax (es), levies and duties levied on the ATM transactions by any Government (Federal/ Provincial/ Local) from time to time and the Bank will be authorizedto deduct these charges from my account without notice.

28. That I keep the Bank indemnified against all claims, losses and damages that may accrue due to my inaction, fault, connivance or mistake.

FINCA Microfinance bank may, at its sole discretion, utilize the services of external service provider/s or agent/s and on such terms as required or necessary, in relation to its products/services."

- Bank's Lien: The Bank shall have the right of set-off and lien, irrespective of any other lien or charge, present as well as future on the deposits held in the Cardholder's Wallet Account to the extent of all outstanding dues, whatsoever, arising as a result of Debit Card services extended to and / or used by the Cardholder. The Bank’s rights hereunder shall not be affected by the Cardholder/s’ bankruptcy, death or winding-up. It shall be the Cardholder/s’ sole responsibility and liability to settle all disputes/ objections The bank shall not be responsible or liable for any loss suffered as a result of the Bank deemed prevented from or delayed in providing services in relation to the Card or any Services.

- The bank shall not be responsible or liable for any loss or damage arising directly from any malfunction of the card or ATM or POS terminal or for any technical or non-technical defect or breakdown of any ATM and or any part thereof the temporary or prolonged non-availability of any services in respect of the card, ATMs or POS Terminal for any reason whatsoever, including without limitation due to any dispute of whatsoever nature.

Responsibility for all transactions processed through the ATMs: The operations through the ATM facility on the Cardholders account(s) can only be through the use of the Card on the machine. The Cardholder shall in all circumstances, accept full responsibility for all transactions processed by the use of his/ her Debit Card, whether or not processed with the Cardholder's knowledge or authority, express or implied. The printed output that is produced at the time of operation of the ATMs are a record of the operation of the ATMs and shall not be construed as the Bank's records. The Bank's records of transactions shall be accepted as conclusive and binding for all purpose.

I hereby undertake to abide by the rules of FINCA Microfinance Bank as amended time to time governing the conduct and operation of the FINCA Pay ATM card and these terms and conditions in all circumstances and indemnify the Bank from any loss and damage that may accrue to me on account of any violation or breach thereof.
